Terms of Use
These Terms of Use (“Terms”) govern your access to and use of newrelease.name.ng and the New Release discovery service (“New Release”, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. What New Release provides
New Release is a metadata and entertainment-discovery service. It organises information about music, artists, films and television, including release dates, credits, artwork, biographies, charts, previews, calendars, links and related catalogue information. It may also provide optional email reminders and links to lawful third-party services.
Unless a page expressly says otherwise, New Release does not host full music recordings, films, television programmes or downloadable copies of those works. Previews, trailers, artwork and metadata may be supplied or delivered by third-party providers.
2. Eligibility and supervision
You must be legally capable of agreeing to these Terms. If you are below the age at which you may enter a binding agreement where you live, you may use the Service only with the permission and supervision of a parent or guardian. A parent or guardian who permits use is responsible for that use to the extent allowed by law.
3. Licence to use the Service
We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use the Service for lawful, non-commercial discovery and informational purposes. This licence does not transfer ownership of the Service or any content.
4. Acceptable use
You must not:
- use the Service in violation of law, regulation or another person's rights;
- attempt to gain unauthorised access to accounts, servers, databases, source code or administrative areas;
- introduce malware, interfere with security controls, overload the Service or disrupt another person's use;
- scrape, crawl, harvest or copy the Service at a scale or frequency that harms availability, bypasses technical limits or violates a provider's terms;
- use automated means to submit forms, create excessive reminders, manipulate analytics or generate fraudulent traffic;
- impersonate another person, misrepresent affiliation, or submit information you know is false, unlawful or infringing;
- remove notices of ownership or use New Release branding in a way that suggests endorsement without written permission; or
- reverse engineer or exploit the Service except where applicable law expressly permits it.
We may use reasonable technical measures to prevent abuse and may restrict or block activity that threatens the Service, users or third parties.
5. Release information and reminders
Release dates, availability, credits, rankings and catalogue details can change, differ by country or contain provider errors. Information is supplied for discovery and general reference, not as a guarantee that a work will be released, available or unchanged on a particular date.
Email reminders are a best-effort convenience. Delivery may be delayed or prevented by schedule changes, network conditions, provider outages, email filters or incorrect addresses. You remain responsible for confirming important dates with an official source. Reminder requests do not subscribe you to unrelated marketing.
6. Third-party content and services
The Service may use or link to information and resources from providers such as Deezer, Last.fm, TMDb, YouTube, JustWatch and other music, film or television services. Names, marks, artwork, media and catalogue data remain subject to the rights and terms of their respective owners.
A link, embed or reference does not mean that New Release owns, controls or endorses the destination, or that the destination endorses New Release. Third-party services may change, become unavailable, charge fees or apply separate terms and privacy policies. You use them at your own discretion.
7. Intellectual property
The New Release name, original interface, site design, software, arrangement, written material and other original elements are protected by applicable intellectual-property laws. Third-party titles, names, logos, images, audio, video and metadata belong to their respective owners and are displayed for identification, commentary, discovery, attribution or under provider licences and terms.
Nothing in these Terms gives you a licence to commercially reproduce, redistribute or create a competing database from the Service. Lawful rights such as fair dealing, fair use or another mandatory exception are not limited by these Terms. Copyright concerns are handled under our Copyright & Takedown Policy.
8. Feedback and messages
You retain ownership of material you submit through the contact form. You give us permission to use that material as reasonably necessary to respond, operate the Service, investigate a report and comply with law. If you send an idea or suggestion, you agree that we may consider and use it without an obligation to compensate you, provided we do not publicly identify you without permission.
9. Privacy
Our Privacy Policy explains how we collect and use personal information. By using the Service, you acknowledge that policy. Do not submit passwords, payment-card details or unnecessary sensitive information through our forms.
10. Availability and changes
We may maintain, change, suspend or discontinue all or part of the Service, and may add or remove providers or features. We try to minimise disruption but do not promise that every page, reminder, link or feature will always be available, error-free or compatible with every device.
11. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available”. We disclaim implied warranties of accuracy, availability, fitness for a particular purpose, merchantability and non-infringement where those warranties may lawfully be disclaimed. Nothing here excludes a warranty or right that applicable law does not allow us to exclude.
New Release is not professional, financial, legal or investment advice. Entertainment ratings, popularity signals and editorial descriptions are informational and may be subjective.
12. Limitation of liability
To the fullest extent permitted by law, New Release and its operators will not be liable for indirect, incidental, special, consequential or punitive loss, or for loss of data, revenue, opportunity or goodwill arising from use of or inability to use the Service, third-party content, missed reminders or unauthorised activity outside our reasonable control.
These limitations do not exclude liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded. Your statutory consumer rights remain unaffected.
13. Responsibility for misuse
To the extent permitted by law, you are responsible for losses and reasonable costs resulting from your unlawful use of the Service, your material breach of these Terms or your violation of another person's rights. We will not seek recovery for losses caused by our own unlawful conduct.
14. Suspension and termination
We may suspend or restrict access when reasonably necessary to investigate abuse, protect security, comply with law or enforce these Terms. Provisions that by their nature should continue after termination—including ownership, disclaimers, limitations and dispute provisions—will survive.
15. Governing law and disputes
These Terms and any non-contractual dispute arising from them are governed by the laws of England and Wales. The courts of England and Wales have non-exclusive jurisdiction, which means either party may also bring a claim in another court that has jurisdiction under mandatory law. If you use the Service as a consumer, this clause does not deprive you of any mandatory consumer protection or right to bring proceedings in the courts available to you where you ordinarily live. Before starting formal proceedings, please contact us and allow a reasonable opportunity to resolve the concern informally. Nothing prevents either party from seeking urgent protective relief or using a regulator or small-claims process where available.
16. General terms
If a provision is found unenforceable, the remaining provisions will continue and the affected provision will be applied as closely as law permits. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer our rights as part of a genuine reorganisation or transfer of the Service, subject to applicable law.
17. Changes and contact
We may revise these Terms as the Service or law changes. The date above identifies the current version. Continued use after an updated version takes effect means you accept it, to the extent permitted by law. For questions, use our contact page.
